Applying for Assault Leave

These leaves are applied for and approved in the Human Resources Leaves Office, 6400 Uptown Blvd. NE, Suite 210 East.

All paperwork must be original.  No third party faxes.

A qualifying employee may not be charged for time lost, up to twenty (20) duty days, resulting from physical injuries caused by an assault while carrying on the duties/responsibilities of the position. An assault shall mean an act which causes a physical injury. This leave is granted with or without pay, depending upon the circumstances of each situation.  See individual negotiated agreements to determine eligibility.

Employee Responsibilities:

Any employee assaulted shall:

  • Seek immediate medical attention in an emergency situation
  • Report the incident to the supervisor immediately
  • Complete a First Report of Injury
  • Contact APS School Police or Albuquerque Police Department to obtain a police report of the incident
  • Contact the Risk Management Department at 830-8466
  • The District reserves the right to have the employee examined by a physician, in order to determine the employee's right to receive benefits.
  • Provide Form A and medical documentation to the Extended Leaves Office to support the need for Leave

Benefits will go into effect immediately and remain in effect until such time as it is determined that benefits should not be provided. In such an event, the employee will assume all expenses, including leave without pay if sick leave has been exhausted.

Extended Leaves Policy

All leaves of ten (10) consecutive work days or less must be requested through and approved by the employee’s principal or supervisor.

Extended leaves of more than ten (10) consecutive days, with or without pay, must be requested through the Human Resources Leaves Office. Employees must complete the required Leave Forms and receive the necessary approval before the leave requested may be taken.

When an employee becomes ill or is injured on the job, sick leave begins at the time of inability to continue work, to the nearest half-hour. An employee, who is already on annual leave, personal leave or leave without pay, including parental leave, may not be eligible to use sick leave benefits.

While on an approved leave, the employee:

  • May not volunteer or perform any duties for the APS District
  • May not utilize APS property for personal use
  • Must turn in all APS equipment (keys, laptops, etc.) prior to start date
