Tobacco/Nicotine: Possession, Paraphernalia, Use

Definition and consequences for possession, paraphernalia, and use of tobacco/nicotine.

Possession, use, and/or distribution of tobacco, including all tobacco products, e-cigarettes, and nicotine liquid containers anywhere on a school campus or at a school related event is prohibited. In addition, students found in possession, distributing, or using tobacco are subject to the provisions of the Tobacco Policy. 

This violation pertains to any tobacco products made or derived from tobacco that are intended for human consumption, including any component, part, or accessory of a tobacco product. This includes among other products, cigarettes, cigars, pipe tobacco, roll-your-own tobacco, dissolvable or smokeless tobacco. E-cigarette means any electronic oral devices, or any part of it, whether manufactured, distributed, marketed, or sold as an e-cigarette, e-cigar, e-pipe, or any other product, name or descriptor; but does not include any product regulated as a drug or device by the US Food and Drug Administration. Nicotine liquid container means a bottle or other container of any substance containing nicotine where the substance is sold, marketed, or intended for use in an e-cigarette.

Tobacco Intervention and support resources are available, please refer the student to the school Crossroads Counselor (if applicable) and/or share the Tobacco/Nicotine Vaping Resources with the student and parent/guardian. (Schools must document resources provided and referrals made.)

Tobacco/Nicotine are NOT a Hearing Violation

Consequences/Disposition

Elementary

Kindergarten to 3rd

  • Utilize intervention strategies
  • Do not exceed maximum consequences for 4th-5th Grade.
  • General practice for K-3 is a suspension of no more than 3 days for a single incident and no referral to hearing.
  • Additional consequences allowed with Associate approval

4th - 5th

  • Utilize intervention strategies
  • 1st Violation - refer for tobacco intervention*
  • 2nd & On-going Violation - Up to 1 day Suspension

Middle/High

  • Utilize intervention strategies
  • 1st Violation - Refer to Crossroads Counselor (if available) and   share resources with student and parent/guardian
  • 2nd & On-going Violation - Up to 1 day Suspension; refer to Crossroads Counselor (if available)
