3F - Unilateral Placement by Parents of Children in Private Schools at Public Expense October 2012

Part B of IDEA does not require Albuquerque Public Schools to pay for the cost of education, including special education and related services, of a child with a disability at a private school or facility if Albuquerque Public Schools made a free appropriate public education available to the child and the parent chooses to place the child in a private school or facility. However, the school district where the private school is located shall include the child in the population whose needs are addressed under the Part B provisions regarding children who have been placed by their parents in a private school in compliance with federal regulation.
