APS Title III programs information
Albuquerque Public Schools follows Federal and State guidance in administering the Title III subgrant.
"Supplemental Support for English Learner Programs and Services Title III—Part A English Language Acquisition, Language Enhancement, and Academic Achievement Act of the ESEA, as amended by the ESSA in December 2015, provides for federal subgrants for LEAs to develop effective language instruction educational programs (LIEPs) to improve the English language proficiency and academic achievement of EL students. Legal obligations under Title VI of the Civil Rights Act and the Equal Educational Opportunities Act of 1974 (EEOA) that include the EL identification process, providing an EL program or service that meets the needs of EL students, and annual English language proficiency assessment, may not be funded using the Title III subgrant. NMPED, Language and Culture Division | 6 Rather, Title III is supplemental funding for serving EL students and cannot be used to fulfill legal obligations under civil rights laws and other federal requirements. Additional information about an LEAs legal obligations under Title VI of the Civil Rights Act of 1964 and the EEOA can be found in the 2015 Dear Colleague Letter.
