Salary Maintenance (Save Harmless) Procedural Directive

Albuquerque Public Schools may hold salaries of employees not participating in or protected by a negotiated agreement harmless (“save harmless”) for twelve (12) months from the effective date of transfer if they are moved into a position with a lower salary or less contract days.

Save harmless shall not apply to employees not participating in or protected by a negotiated agreement under the following circumstances:

  • When the employee is transferred due to unsatisfactory performance
  • When the employee is transferred at the employee’s request

At the discretion of the superintendent, salaries of employees not participating in or protected by a negotiated agreement may be held harmless for an additional twelve (12) months.  The superintendent may extend the save harmless period for an employee not participating in or protected by a collective bargaining agreement in twelve (12) month intervals.

The superintendent shall notify the executive director of Human Resources of the decision to hold a salary harmless.  The executive director of Human Resources shall send written notification to the employee prior to the end of the twelve month interval to notify the employee of their salary.  The executive director of Human Resources shall implement the appropriate salary for personnel in this situation.

Albuquerque Public Schools shall follow all requirements and provisions outlined in the applicable negotiated agreement for employees who do participate in or are protected by a negotiated agreement.
